Ranchi: Leader of legislature wing of BJP Babulal Marandi on Wednesday filed a caveat in the Supreme Court through which he has pleaded that incase the matter of anti-defection is brought in the court then his side should also be heard.
Babulal Marandi was recently granted relief by the High Court over the hearing in the court of Jharkhand Speaker Ravindranath Mahto over the anti-defection law as the court has barred the hearing in the speaker court till further orders. Most likely the Vidhan Sabha will approach the Supreme Court in this case therefore Mr Marandi through his lawyer has moved the caveat in the court. The development has been confirmed by lawyer of Babulal Marandi RN Sahai.
It is worth mentioning that Speaker had served a notice to Babulal Marandi in an anti defection case over which Marandi had approached the High Court stating that Speaker can not undertake suo-motu cognisance in this case. On the other hand the Speaker had informed that as per the rules of Jharkhand Vidhan Sabha he has the power to do the same. Despite the orders of the High Court the Speaker Court has once again issued a notice to Babulal Marandi on which his lawyer said that on this issue further legal action will be taken.
