MLA Jairam Mahato Gets Anticipatory Bail in Barwadda Case, Arrest Averted

Dumri MLA Jairam Mahato received major relief from the court on Monday after the special MP/MLA court granted anticipatory bail to him and three other accused in a case registered at Barwadda police station.

Special Judge Durgesh Chandra Awasthi approved the anticipatory bail pleas of Mahato, Sushil Mandal, Mahendra Sao and Raj Kumar Mandal. The order means the four accused will not face arrest in connection with the case, subject to the conditions imposed by the court.

The court had reserved its order on September 10 after hearing arguments from defence counsel Shahnawaz and the Additional Public Prosecutor. The verdict was scheduled to be pronounced on September 14.

During the hearing, the defence argued that Mahato and the other accused had been implicated in the case due to political vendetta. The prosecution opposed the defence's arguments and sought to contest the anticipatory bail pleas.

Earlier, the court had declined to grant immediate protection from arrest to Mahato. The subsequent approval of his anticipatory bail application has now provided relief to the legislator and the three other accused.

The case was registered on August 22 on the basis of a complaint by Barwadda police station in-charge Ravi Kumar. FIR No. 146/26 named Jairam Mahato, Sushil Mandal and others as accused.

According to the police, Mahato allegedly misbehaved with police officers inside the station premises and asked his supporters to secure the release of Ganesh Das, who was being held in the lock-up. Police further alleged that Mahato's supporters created a disturbance at the police station and obstructed personnel from carrying out their duties.

Mahato and the other three accused subsequently approached the court seeking protection from arrest. The court's decision on Monday has brought temporary legal relief to the Dumri MLA while the underlying case continues.
