Speaker court has no right to give verdict on merger or demerger of party: JVM

Ranchi: Lawyer of the Jharkhand Vikas Morcha (Prajatantrik) Raj Nandan Sahay said that the speaker court has no right to give a verdict on merger or demerger of any party and it is against his working area. Addressing a Press Conference at the party headquarters here he said that any recognised party can only be merged or demerged on the basis of the constitution which has been laid down by the Election commission of India, therefore, the decision of the speaker Court would be challenged in the High Court.

The court of Jharkhand assembly speaker Dinesh Oraon had in his verdict on Wednesday declared the merger of 6 MLAs into the
BJP as valid and had cancelled the petition filed by former Chief Minister Babulal Marandi and his party colleague Pradeep Yadav
demanding cancellation of the membership of the house of the six MLAs citing a violation of the tenth schedule of the constitution.
The lawyer said that as per the party constitution it has been mentioned under section 20 para 1 and 2 that party can be only be merged with the support of two-third members and among the 57 who appeared before the court only two were members of the central committee. 

On the other hand, party Central General Secretary Bandhu Tirkey said that decision of the speaker was incorrect and unconstitutional and described the verdict as the murder of democracy and said that the party will approach the high court and Election Commission over the issue.
